Effective March 29, 2021, SPSL was designed to support employees impacted by COVID-19. This law applies exclusively to employers with more than 25 employees, ensuring that individuals who may be suffering from COVID-19 symptoms, or are involved in caretaking responsibilities, have access to paid leave. Importantly, independent contractors are not covered unless misclassified as employees.

To qualify for SPSL, employees must demonstrate one of several COVID-19 related circumstances, such as needing to self-quarantine, caring for a family member with symptoms, or attending a vaccination appointment. Full-time employees can receive up to 80 hours of SPSL, while part-time employees are compensated based on the average hours they’ve worked, calculated over a specific time frame.

Employers must process SPSL requests without requiring medical certification and cannot compel employees to use other forms of leave. Moreover, they must issue a wage statement reflecting the SPSL pay distinctly from any other sick pay.
